Takedown Policy

This policy explains how Fiatly handles reports of infringing, fraudulent, or otherwise prohibited content on our marketplace.

1. Purpose and Scope

Fiatly is committed to maintaining a safe, lawful, and trustworthy marketplace. This Takedown Policy governs how we handle reports of content, listings, or accounts that may violate our policies or applicable law — beyond copyright infringement (which is handled separately under our DMCA Policy).

We reserve the right to remove any content or restrict any account that we determine, in our sole discretion, violates this policy or poses legal, reputational, or safety risks to our users, creators, or the platform.

2. What Can Be Reported

You may submit a takedown report for any of the following categories of content or conduct on our platform:

Intellectual property infringement (non-copyright): trademark infringement, unauthorized use of trade names, logos, or brand identities, and passing-off.

Impersonation and identity fraud: NFTs or accounts that falsely represent themselves as a known artist, brand, celebrity, or established collection with the intent to deceive buyers.

Stolen or unauthorized NFTs: NFTs that were minted without the consent of the original creator, or that originate from a compromised or fraudulently operated smart contract.

Illegal or prohibited content: content that is obscene, depicts child sexual abuse material (CSAM), incites violence or hatred, constitutes defamation, or is otherwise unlawful under applicable law.

Fraudulent collections and scams: rug-pull projects, fake collections designed to defraud buyers, phishing-linked NFTs, and listings promoting investment fraud.

Sanctions and prohibited parties: NFTs created by or for the benefit of individuals or entities subject to applicable international sanctions.

3. How to Submit a Report

To submit a takedown report, send an email to [email protected] with the subject line "Takedown Report". Reports may also be submitted via the contact form on our platform.

Providing complete and accurate information will allow us to investigate your report more quickly and effectively. Anonymous reports will be reviewed on their merits but may be deprioritized if we cannot obtain clarification.

4. Required Information

Your takedown report should include the following information to facilitate prompt review:

1. Your name and contact email address (kept confidential; used only to follow up if needed).

2. The URL or identifier of the NFT listing, collection, or account you are reporting.

3. The category of your complaint (select from the types listed in Section 2).

4. A clear description of why you believe the content violates our policies or applicable law.

5. Any supporting evidence: links to the original work, public records, screenshots, transaction hashes, or other documentation that substantiates your claim.

6. If you are reporting on behalf of a rights holder or organization, confirm your authority to act on their behalf.

Reports that do not include the URL of the reported content and a description of the concern may not be actionable.

5. Review Process and Timeframe

Upon receipt of a takedown report, Fiatly will acknowledge the report (where contact information is provided) and commence an internal review. Our standard review timeline is as follows:

Initial acknowledgement: within 2 business days of receiving the report.

Substantive review and decision: within 10 business days for standard reports; within 2 business days for urgent reports involving illegal content such as CSAM, active scams causing financial harm, or content relating to violence.

Complex or contested reports involving high-value NFTs, unclear ownership, or disputed facts may require additional time. We will keep the reporting party informed of material delays.

6. Possible Actions

Following review, Fiatly may take one or more of the following actions depending on the severity and nature of the violation:

Content delisting: removing the NFT listing from our marketplace interface so it is no longer discoverable or purchasable on our platform.

Metadata and media removal: disabling the display of associated images, descriptions, or other hosted media.

Account restriction or suspension: temporarily restricting or permanently suspending the account responsible for the reported content.

Account termination: permanently closing accounts involved in serious, repeated, or egregious violations, including fraud and CSAM.

Referral to authorities: reporting relevant information to law-enforcement or regulatory bodies where the content involves illegal activity.

No action: where we determine the report is unfounded, made in bad faith, or where the content does not violate our policies.

7. Notice to Content Providers

Where we take action to delist or restrict content based on a third-party report, we will endeavor to notify the content provider (the creator or seller of the reported NFT) of the action taken, unless doing so would be unlawful (for example, where a law-enforcement agency requests confidentiality) or would undermine an ongoing investigation.

We will not disclose the identity or contact information of the person who submitted the report to the content provider without their prior consent.

8. Appeals

If you are a content provider whose NFT or account has been delisted or restricted, you may submit an appeal by emailing [email protected] with the subject line "Takedown Appeal" within 30 days of the action being taken.

Your appeal must include: (a) your account or seller identifier; (b) the URL or identifier of the delisted content; (c) the reason you believe the action was taken in error; and (d) any evidence supporting your position.

We will review all appeals and respond within 10 business days. Our decision on appeal is final for the purposes of our internal process, and does not prejudice any legal rights you may have.

9. Abuse of the Report Process

This takedown process must not be used to harass creators, suppress legitimate artistic expression, eliminate competitive listings, or for any purpose other than good-faith reporting of genuine violations.

Submitting false, misleading, or frivolous reports may result in your email address being blocked from submitting further reports, and may expose you to legal liability for tortious interference or other applicable claims. Fiatly reserves the right to take legal action against parties who systematically abuse the report process.
